This document constitutes a legally binding agreement between you (“the Customer,” “you,” or “your”) and Margarita Nazarenko (“we,” “us,” or “our”), governing your purchase and use of digital products, online courses, masterclasses, downloadable content, and related services (collectively, the “Services”) offered via margaritanazarenko.com (“the Website”).

 

By purchasing or accessing any Services from this Website, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.

 

1. Digital Products & Services

 All products and services sold via this Website are digital in nature and delivered electronically. No physical products are shipped.

Upon purchase, you are granted a non-exclusive, non-transferable, revocable license to access and use the digital content strictly for your personal, non-commercial use, in accordance with these Terms and any additional terms provided at point of sale.

Lifetime Access Clause

If a product or course is sold with “Lifetime Access,” this refers to the lifetime of the product as it is hosted on our current platform (e.g., Kajabi). “Lifetime” does not mean the lifetime of the purchaser or of the business. We reserve the right to update, retire, or discontinue any product, service, or platform at our discretion and without obligation to continue access indefinitely.

Should we transition to a new platform, retire a product, or close the business, access to the associated content may no longer be available. We will make reasonable efforts to provide advance notice of any such changes whenever possible.

Unless otherwise stated, standard access to all digital products is granted for a period of two (2) years from the date of purchase.

 

  

2. Intellectual Property Rights

All intellectual property rights, including copyright, moral rights, trademarks, design rights, and other proprietary rights in and to the Services and content (including but not limited to course materials, written content, video, audio, graphics, branding, and downloadable files) remain the sole and exclusive property of Margarita Nazarenko.

Unauthorised reproduction, distribution, public display, modification, resale, or commercial exploitation of any content or materials is strictly prohibited and may result in legal action, including claims for infringement under the Copyright Act 1968 (Cth), Trade Marks Act 1995 (Cth), and other applicable IP legislation.

 

3. Payment Terms

All fees are payable in full at the time of purchase via approved third-party payment processors. Prices are listed in AUD (or otherwise as indicated) and may be subject to change without notice.

We reserve the right to refuse, cancel, or limit orders at our sole discretion.

 

4. Refunds & Cancellations

Due to the intangible and immediate-access nature of digital products and services, all sales are final. No refunds, cancellations, or exchanges will be provided once a transaction has been completed, unless required by Australian Consumer Law.

Should you experience technical difficulties in accessing your purchase, you must notify us within 7 days at [email protected] for reasonable assistance.

The Services and content provided on this Website are for informational and educational purposes only. No guarantees, representations, or warranties are made regarding your expected results from any product or service. 

To the maximum extent permitted by law, we disclaim liability for any indirect, incidental, consequential, or special damages arising out of your use or inability to use our Services.

 

6. Governing Law & Jurisdiction

 

These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of NSW for any disputes arising in connection with these Terms.
